Division administrators are scrutinized for their on/off duty conduct as their activities could be perceived as incompatible with the employee’s conditions of employment. As such, the disgraceful conduct displayed in the video that was sent to many people in Mr. Cassetty’s division not only could impair the performance of his duties, but also cause discredit to the agency. Should Deputy Commissioner Cassetty’s identity be publicized from this pornographic video that was sent to an investigative reporter at Channel 8 News, in Las Vegas, it would undoubtedly bring discredit to his division, and quite possibly, the Governor’s office.
